Welcome to CarBot. By accessing or using CarBot.monster (the "Site") or any CarBot services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

By providing your mobile phone number and opting in to SMS communications, you agree to receive text messages from CarBot related to your vehicle search activity and service updates.

Message frequency varies based on your search activity. Message and data rates may apply.

To opt out at any time: Reply STOP to any CarBot text message. You will receive one final confirmation and no further messages will be sent.

CarBot will not share your mobile number with third parties for marketing purposes. See our Privacy Policy for full details.

1. Acceptance of Terms

By using the Service, you represent that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to be bound by them. These Terms apply to all visitors, users, and anyone who accesses the Service.

2. Description of Service

CarBot is an AI-powered vehicle research and buying assistance platform. The Service helps users:

Search and filter used vehicle listings from third-party data sources
Contact dealers to request out-the-door (OTD) pricing information
Compare vehicle listings using AI-generated scoring and analysis
Receive AI-assisted negotiation guidance and draft communications

CarBot is an informational and automation tool. We are not a licensed car dealer, broker, or financial institution. All vehicle transactions occur directly between the user and the dealer.

3. SMS Communications and Opt-In

CarBot may send transactional SMS messages to users who have explicitly opted in. By opting in, you agree to:

Receive text messages from CarBot related to your active vehicle searches and deal activity
Standard carrier message and data rates that may apply to SMS messages
Variable message frequency depending on your search activity level

You may opt out at any time by replying STOP to any CarBot message. Opting out will stop all further SMS communications. This opt-out will not affect your ability to use other features of the Service.

CarBot does not use your mobile number for marketing unrelated to your active use of the Service, and will not share or sell your number to third parties.

4. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service to send spam, unsolicited messages, or engage in any form of harassment
Attempt to reverse-engineer, scrape, or otherwise access the Service's underlying systems without authorization
Misrepresent your identity or provide false information to dealers or CarBot
Use the Service for any commercial purpose other than your personal vehicle purchase

5. Disclaimers and No Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. CarBot does not warrant that:

Vehicle listings are accurate, complete, or current
Any specific savings, dealer responses, or negotiation outcomes will be achieved
The Service will be uninterrupted, error-free, or secure at all times

CarBot's AI-generated scoring and negotiation suggestions are informational only and do not constitute financial, legal, or professional advice. You are solely responsible for your purchasing decisions.

6. Limitation of Liability

To the fullest extent permitted by applicable law, CarBot and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

CarBot's total liability to you for any claims arising under these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $100, whichever is greater.

7. Third-Party Services

The Service integrates with or links to third-party services (such as vehicle listing data providers, SMS carriers, and email platforms). CarBot is not responsible for the content, accuracy, or practices of any third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the CarBot name, logo, software, AI models, and scoring methodology — are owned by CarBot and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, CarBot, or third parties.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.
